18-Month Extension Announced for Venezuelan TPS

The Secretary of Homeland Security announced the 18-month extension of TPS for Venezuela to continue through March 10, 2024 for those already eligible. More details regarding the re-registration process and extension of employment authorization documents are still unknown, as the current application cycle is running until September 9th, 2022, however, further announcements are expected.

DACA’s Legality to Face Re-Consideration

A hearing was held by the Fifth U.S. Circuit Court of Appeals, as the state of Texas fights the DACA program’s legality, potentially bringing it to an end. At the current moment, the court’s resulting decisions are to be determined within the coming months. If found unlawful, it is not certain that the program will end immediately, therefore eligible immigrants who are due to renew their DACA status soon are encouraged to do so.

Secretary Mayorkas Designates Temporary Protected Status (TPS) for Ukraine

On March 8, 2021, the Department of Homeland Security designated Ukraine a TPS country because “Russia’s premeditated and unprovoked attack on Ukraine has resulted in an ongoing war, senseless violence, and Ukrainians forced to seek refuge in other countries.” This designation is good until September 2022.
Individuals eligible for TPS under this designation must have continuously resided in the United States since March 1, 2022 or before. Applications expected to be available soon.
Secretary Mayorkas Re-Designates Temporary Protected Status (TPS) for Haiti

The Department of Homeland Security announced a new 18-month designation of Haiti for Temporary Protected Status (TPS). This new TPS designation enables Haitian nationals currently residing in the United States as of May 21, 2021 to file initial applications for TPS and current beneficiaries to renew their TPS status, so long as they meet eligibility requirements.

Protected Status (TPS) for Venezuela and Myanmar

On March 8, 2021, the Department of Homeland Security designated Venezuela a TPS country due to conditions that prevent nationals from returning. This designation is good until September 2022.
On March 12, 2021, the Biden administration declared Myanmar as a TPS country.
TPS and work authorization applications are now available for individuals who meet eligibility requirements for each of these countries.
Trump’s Public Charge Rule Blocked
March 9, 2021
USCIS is no longer applying the August 2019 Public Charge Final Rule introduced by Former President Trump. A public charge is now defined as it was in the pre-Trump era as someone who is "primarily dependent on the government for subsistence as demonstrated by either (i) the receipt of public cash assistance for income maintenance or (ii) institutionalization for long-term care at government expense."
Immigrants now will not have to be afraid of not being able to receive lawful permanent residence as a result of receiving housing, food and health care assistance.
